The Maryland Building Industry Association reviewed 241 of the 3480 bills introduced by the Senate and the House this year. MBIA took a position on 174 bills, submitted testimony on 116. Pro Housing Legislation
SB483/ HB599- Housing and Development Financing Act of 2024- Establishing the Maryland Community Investment Corporation as an independent unit to make investments in certain low- income communities; requires the Corporation to apply for an allocation of federal new markets tax credits. Effective date July 1, 2024.
SB472/HB581- State Government Permit, Licenses, and Certificates- Processing (Transparent Government Act of 2024)- Requiring certain departments and independent units to create a certain catalog of information relating to permits, licenses, and certificates issued by the department or independent unit and submit the catalog to the Governor on or before October 1, 2025.
SB484/ HB538- Housing Expansion and Affordability Act of 2024- Creates a Historic Property Revitalization Director, requires a local government to provide a bonus density for certain qualified projects in multifamily zoned areas. The qualified projects include 1) Transit oriented development within .75 miles of rail station that have 15% affordable units (60% AMI) or 20% in jurisdictions that currently have MPDU program. 2) Formerly State or federally owned properties that have 25% affordable units (60% AMI). 3) Land owned by a 501c(3) that have 25% affordable units (60% AMI). The bill also requires local jurisdictions to permit mobile and modular housing in areas that are formerly state owned. The legislation also allows for expedited review for qualified projects. Effective date: January 1, 2025.

SB835/HB992- Environment- Delegated Authorities- Well and Septic Program Permits- Requires local jurisdictions in which the Department of Environment has delegate authority to administer a septic and well program to submit by December 1, 2024, a schedule of review times for well and septic program permits for approval. Requires entities to submit well and septic program permit date every 3 months after initial submission. Effective: June 1, 2024.

SB1086- Environment- Environmental Justice Districts- Designation and Requirement- Authorizing a resident of a local jurisdiction or an overburdened and underserved community in the State to apply to the Department of the Environment to request the designation of a certain area as an environmental justice district in a certain manner.
SB1088- Environment- Public Participation in the Permitting Process- Alterations- authorizing judicial review of certain environmental permitting and license decisions by the Department of the Environment at the request of certain persons who meet certain federal standing requirements under certain circumstances.
HB210- Maryland Building Performance Standards- Fossil Fuel Usa and Electric- Ready Standards- Requiring the Maryland Department of Labor to adopt, on or before January 1, 2025, and as part of the Maryland Building Performance Standards, a requirement that new buildings meet all energy demands of the building without the use of fossil fuel and an electric ready standard.
HB245- Department of the Environment- Fees, Penalties, Funding and Regulation- authorizing the Department of the Environment to charge a fee for processing and issuing on- site sewage disposal permits and increases other fees with in the department. AMENDMENTS: MBIA successfully negotiated an amendment capping the septic fees at $575. Effective date: June 1, 2024.
HB516- Climate Crisis and Environmental Justice Act of 2024- Establishing the Climate Crisis Initiative in the Department of the Environment to provide for the assessment of greenhouse gas pollution fees, the provision of certain benefits to households and employers, and the funding of certain climate- related activities; providing for the collection and use of certain greenhouse gas pollution fees.
HB729- Vernal Pool Wetlands Protection Act of 2024- Requiring the Department of the Environment to adopt regulations to protect and preserve vernal pools.
HB1511- Forest Conservation Act- Modifications- Requires the Department of Natural Resources to update a model local government ordinance and adopt certain regulations on or before July 1, 2025. Pushes back the effective date of 2023 FCA modifications to July 1, 2026.
HB1272- Department of the Environment- Cap-and-Invest Program- Establishment- Requiring the Department of the Environment to develop a cap-and-invest program that reduces climate-altering emissions in the State on or before December 31,2024.

SB665/ HB1496- Maryland Condominium Act - Amendments to the Declaration- The bill reduces from 80% to 66 2/3%, the threshold of unit owners listed on the current roster of a condominium association to consent to an amendment of the condominium’s declarations. Amendments were requested by MBIA in prior session that were included in this legislation that maintains the current 80% threshold when any of the unite are owned by the developer. Effective: October 1, 2024.
SB1157/ HB281- Cooperative Housing Corporations, Condominiums, and Homeowners Associations- Funding of Reserve Accounts- Bill clarified when and how funding of reserves needed to be planned for. Changed from 3 to 5 years the number of years that a common ownership community has to complete initial reserve study and attain funding level recommended in the study.

The developments have at least 20 units and 15% must be affordable (80% AMI). Effective June 1, 2024.
